TERMS OF USE.

These Terms of Use govern your use of Aura-In and outline important information about the Aura-In Service, detailed below. When you create an Aura-In account or use the Aura-In platform, you agree to abide by these Terms.

 

Aura-In is a product of Bars Opus Ltd. As such, these Terms of Use constitute a legally binding agreement between you and Bars Opus Ltd. By accessing or using any part of the Aura-In Service, you acknowledge and agree to be bound by these Terms, which may be updated from time to time as described in Section 11.

 

Aura-In offers a suite of tools and features for booking appointments, managing beauty and grooming services, and connecting clients with professionals. In some cases, we may present supplemental terms specific to a feature, app module, or service. Where any such supplemental terms conflict with these Terms, the supplemental terms will govern your use of that specific feature or service.

-1. Registration on Aura-In and Account Security.

To ensure a safe and reliable experience for all users of Aura-In, we require the following commitments from you upon registration and throughout your use of the platform:

 

1.1 You must be at least 16 years of age to use Aura-In.

1.2 Individuals who are registered sex offenders are strictly prohibited from using Aura-In.

1.3 You agree not to provide false or misleading personal information when registering, and you may not create an account on behalf of someone else without their explicit permission.

1.4 You may only maintain one personal account. Creating multiple accounts to bypass suspensions or restrictions is not allowed.

1.5 You are responsible for ensuring that your contact and profile information remains accurate and up to date at all times.

1.6 If you select a username, display name, or any identifier that infringes on the intellectual property rights of another user or entity, Aura-In reserves the right to remove or change it.

1.7 You are solely responsible for maintaining the security and confidentiality of your account credentials. Aura-In will not be held liable for any loss or damage resulting from your failure to protect your account.

1.8 You agree not to share your account or password with others, including non-users, and will take steps to prevent unauthorized access to your account.

-2.  User Responsibilities and Content Ownership.

2.1 You are fully responsible for your use of Aura-In, including any content, information, or materials you post, upload, or otherwise make available through the platform (“Content” and “Information”). This includes compliance with all applicable laws, regulations, and platform policies.

2.2 You should only upload Content and Information that you are comfortable sharing with others. By doing so, you affirm that you own the rights to the Content and Information you share on Aura-In, or that you have the necessary permissions to share it.

2.3 You retain ownership of all intellectual property rights in any Content or Information you submit, post, or display on Aura-In. However, for any content protected by intellectual property laws (e.g., images, videos, written content), you grant Aura-In a global, non-exclusive, royalty-free, transferable, and sub-licensable license to use, store, reproduce, process, publish, display, and distribute such content on or through the platform (“IP License”). You represent and warrant that you have the necessary rights and authority to grant this license.

2.4 This IP License will end once you delete the relevant IP Content from your account, unless the content has already been shared with others who have not yet removed it.

2.5 By publishing Content or Information on Aura-In, you acknowledge and agree that it may be viewed and used by others on the platform, and associated with your account (including your name and profile image where applicable).

-3. Safety and Community Standards

To ensure a safe and respectful environment for all users of Aura-In, we ask that you agree to the following commitments:

3.1 You must not attempt to solicit or gain unauthorized access to another user’s account or login credentials.

3.2 You must not collect, store, or use another user’s Content or Information without their explicit permission.

3.3 You may not impersonate any individual or entity on Aura-In in a way that is intended to mislead, confuse, or deceive others.

3.4 Bullying, harassment, or any form of intimidation against other users is strictly prohibited.

3.5 You may not post or share content that includes hate speech, threats, explicit material, incites violence, or contains nudity or graphic violence.

3.6 The upload or distribution of malware, viruses, or any malicious code is forbidden.

3.7 You may not post unauthorized commercial messages, promotional content, or spam.

3.8 If you develop or promote third-party applications related to adult, alcohol, or dating content, you must implement proper age restrictions in accordance with applicable laws.

3.9 Engaging in unlawful multi-level marketing, such as pyramid schemes, through Aura-In is not permitted.

3.10 You must not use Aura-In to carry out any illegal, deceptive, harmful, or discriminatory actions.

3.11 You must refrain from any activity that may compromise the integrity, performance, or appearance of the platform (e.g., denial-of-service attacks or attempts to interfere with the platform’s functionality).

3.12 Aura-In may not be used to support or engage in any illegal activity or for any unlawful purpose.

3.13 You must not facilitate, promote, or encourage others to violate these Terms of Use.

3.14 Child Protection and Safety:

Aura-In maintains a zero-tolerance policy for child exploitation, abuse, or any inappropriate content involving minors. Users must comply with all applicable child protection laws. Any concerns should be immediately reported via our in-app reporting tool or by contacting support@ybarsopus.com. For more details, please refer to our 

-4. Protecting the Rights of Others

Respecting the rights of others is a fundamental principle of Aura-In, and we expect all users to uphold the same standard. By using Aura-In, you agree to the following:

4.1 You must not post content or engage in activities that infringe upon or violate someone else’s rights, including intellectual property rights, privacy rights, or any applicable laws.

4.2 We reserve the right to remove any content or information you upload to Aura-In if, in our reasonable judgment, it violates these Terms of Use or our related policies.

4.3 If your content is removed due to an alleged copyright infringement, and you believe it was removed in error, you will be provided an opportunity to appeal. The outcome of any appeal will be final and binding.

4.4 Repeated infringement of others’ intellectual property rights may result in the suspension or permanent disabling of your account, at our sole discretion.

4.5 You may not use our copyrights, trademarks, logos, or any marks confusingly similar to those belonging to Aura-In without our express prior written consent. All rights, titles, and interests in Aura-In (excluding content submitted by users) remain the exclusive property of Aura-In and its licensors.

4.6 If you collect information from other users of Aura-In, you must obtain their express consent, clearly disclose that you (and not Aura-In) are collecting the information, and explain how you intend to use it.

4.7 You are prohibited from posting your own or anyone else’s personal identification documents, sensitive financial information, or similar private data on Aura-In, as doing so may expose users to risks of fraud or identity theft.

4.8 Buying, selling, or transferring Aura-In accounts is strictly forbidden.

-5. Service Booking, rendering and Safety

Aura-In provides a platform for users to discover, book, and engage with professional services offered by salons, barber shops, spas, and other service providers. We are committed to ensuring the safety and satisfaction of users while using our platform. However, Aura-In is not the service provider itself, nor does it directly manage or supervise the services rendered. Users book and attend appointments at their own discretion and are responsible for their own experience at the chosen location.

 

While Aura-In strives to maintain a trustworthy and secure platform, we cannot guarantee the accuracy, reliability, or quality of every service listing due to the nature of user-generated content. Users are encouraged to exercise their own judgment and verify service details independently when necessary.

 

By using Aura-In, you acknowledge the following:

 

  • Aura-In is not liable for any personal injury, dissatisfaction, property damage, or other harm resulting from your visit to or experience at any service provider booked through the platform.

  • Although Aura-In encourages service providers to maintain professional standards and provide complete, accurate information about their services, we do not directly supervise, endorse, or certify any service provider listed on the platform.

  • Users should exercise reasonable caution, especially when booking services at new locations or with unfamiliar providers, and should independently review any relevant health, hygiene, or safety practices in place.

  • Users are responsible for adhering to the policies and guidelines of the service provider they choose to book with.

  • We urge all users and service providers to act professionally and ethically, to ensure a safe, respectful, and positive experience for everyone.

-6. Service Booking and Payment Terms

To confirm a service booking through Aura-In, clients are required to pay a 30% non-refundable deposit of the total service price, along with an additional GHC 2 processing fee. This payment secures your appointment with the selected service provider.

Please note:

  • The 30% deposit and processing fee are non-refundable, even if you later choose to cancel or not attend the service.

  • The remaining 70% balance is to be paid directly to the service provider after the service has been completed, unless otherwise specified.

By proceeding with a booking, you acknowledge and agree to these terms. This policy ensures fairness and protects the time and availability of service providers on the platform.

-7. Booking Services

When booking services through Aura-In, you are entering into a direct agreement with the independent service provider (such as a barber, stylist, beautician, or creative professional). Aura-In is not a party to this contract and assumes no responsibility or liability for the services rendered.

All service-related obligations — including but not limited to quality, timeliness, safety, and customer satisfaction — are solely between you and the service provider. Aura-In simply facilitates the connection and booking process through the platform but does not supervise or guarantee any services booked.

By proceeding with a booking on Aura-In, you acknowledge and accept that any disputes, claims, or concerns related to the services must be resolved directly with the service provider.

-8. Permissions You Grant to Aura-In.

We do not claim ownership of the content you create or share. However, by posting, uploading, or sharing content that is protected by intellectual property rights (such as photos, videos, or reviews) through the Aura-In platform, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to:

  • Host,

  • Use,

  • Distribute,

  • Modify,

  • Run,

  • Copy,

  • Publicly perform or display,

  • Translate, and

  • Create derivative works of your content.

This license enables us to operate, promote, and improve the Service, and is limited to the purpose of providing a better experience for users.

-9. Who Has Rights Under this Agreement?
9.1 No Third-Party Rights

This agreement does not grant any rights to third parties. Only you and Aura-In (operated by Bars Opus Ltd.) are parties to this agreement.

9.2 No Transfer Without Consent

You may not transfer your rights or obligations under this agreement to anyone else without our prior written consent.

9.3 Transfer of Our Rights

We reserve the right to assign or transfer our rights and obligations under this agreement to others. This may occur, for example, in the event of a merger, acquisition, sale of assets, or by operation of law.

-10. How We Will Handle Disputes.

10.1 Governing Law and Jurisdiction

If you are a consumer, the laws of the country where you reside will apply to any claim, dispute, or cause of action you have against Aura-In that arises from or relates to these Terms (“claim”). You may bring such claims in any competent court within your country that has jurisdiction.

In all other cases, you agree that any claim must be resolved exclusively in Ghana. You submit to the personal jurisdiction of the courts in Ghana, and the laws of the Republic of Ghana will govern these Terms and any claims, without regard to conflict of law principles.

10.2 Unsolicited Material

We appreciate any feedback, suggestions, or ideas you provide. However, by submitting unsolicited material, you agree that we may use it freely without any restriction or obligation to compensate you, and we are under no obligation to maintain its confidentiality.

-11. Other

11.1 These Terms constitute the entire agreement between you and Aura-In regarding your use of the app and supersede any prior agreements between the parties.

11.2 If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

11.3 Our failure to enforce any part of these Terms will not be considered a waiver of our rights.

11.4 Any amendment or waiver of these Terms must be made in writing and signed by us, or posted through official Aura-In communication channels.

11.5 You may not transfer any of your rights or obligations under these Terms to anyone else without our prior written consent.

11.6 All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition, sale of assets, by operation of law, or otherwise.

11.7 Nothing in these Terms shall prevent us from complying with applicable laws and regulations.

11.8 These Terms do not confer any third-party beneficiary rights.

11.9 We reserve all rights not expressly granted to you under these Terms.

11.10 You agree to comply with all applicable laws and regulations while using Aura-In.

-12. Termination.

We reserve the right to suspend or terminate your account if you violate these Terms, any related policies, or if your actions create or may create a risk or potential legal exposure for Aura-In.

We will make reasonable efforts to notify you by email or upon your next attempt to access your account.

In the event of suspension or termination, these Terms shall end between you and Aura-In, but the following provisions will survive termination: Sections 2.4, 2.5, 3, 4, and 8.

-13. Indemnification.

By using Aura-In, you agree to indemnify, defend, and hold harmless Aura-In, its parent company Bars Opus Ltd., and their respective affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of these Terms of Use,

  • Your misuse of the Aura-In app, including but not limited to unauthorized use of its content, services, and products, or

  • Your use of any information obtained through the app.

-14. Updating These Terms
We may update our Services and policies from time to time, and as a result, we may also need to revise these Terms to accurately reflect any changes. Unless otherwise required by law, we will provide you with notice (such as through our app or other communication channels) before any material changes take effect, giving you an opportunity to review the updated Terms.

By continuing to use Aura-In after the changes become effective, you agree to be bound by the revised Terms. If you do not agree with the updated Terms, you should discontinue using our Services.
